TUPE doesn't include pensions.

Rubbish.

(and there's also the 1993 Railways Act for a proportion of staff
transferring)

I was out of date but it's still not a full obligation to replicate
the entitlement from the previous employer's scheme. "If the proposed
alternative scheme offers benefits at a lower value than the previous
scheme then unfortunately, there is not a great deal a dissatisfied
employee can do practically if the new scheme is in compliance with
the relevant legislation."

In the case of the railways though, as EMT explained in their staff
briefings (that were available on the www), the TOCs use an
umbrella 'Railway Pension Scheme', which has sub divisions per TOC,
and the former MML section has just been renamed the East MIdlands
section, with former MML employees basically staying in the same
section (renamed), and ex CT employees moving sections.

Yes, but the dispute leading to the strikes against NatEx franchises were
much more obscure, surely?
